Membership Terms Of Agreement

Helping Our Music Evolve, Inc. (doing business as HOME, and herein referred to as “H.O.M.E.”, “we", “our”, or "us") offers a shared, community-driven workspace for musicians and music industry professionals. It exists because of you and for you. As a member, you will not just be a customer of H.O.M.E.; you will be an active part of what H.O.M.E. is and does for you and for others. You will have special privileges within H.O.M.E. designated workspaces (“Facilities”) and associated activities.

Before finishing your H.O.M.E. membership application, please read the following terms of service ("Terms") carefully. If you, the user, ("you", “your”, or "Member") agree to these Terms, please go back to the previous page and complete your application. This will constitute a binding agreement between you and H.O.M.E. Please note that any violation of these Terms may result in termination of the H.O.M.E. membership and any service to you.

H.O.M.E. reserves the right to change these Terms from time to time, so please check back periodically for any changes. You can always view the most current version of these Terms at homeformusic.org/terms and the “Last Updated” date at the top of this page will be revised. If you do not agree to changes made to these Terms, your sole and exclusive remedy is to cancel your H.O.M.E. account ("Account").

Description of Service and Levels of Membership

H.O.M.E. currently provides registered and paid members with access to a number of on-line, in-person, and physical resources, including but not limited to written articles, videos, resources, tools, production facilities, coworking space, and member programming via HOME for Music (an affiliated 3rd Party “Website”) and designated H.O.M.E. workspaces (collectively, the “Service”). Unless expressly stated otherwise, any new products or features added to the current Service will be subject to these Terms. H.O.M.E. provides this Service solely to individuals and companies who are working within the music industry and has no obligation to provide it to any other parties.

H.O.M.E. offers different levels of membership for your Account to help meet your needs. The level of membership you purchase will provide you with different opportunities and access to our locations and facilities. For full details, please visit https://www.homeformusic.org/become-a-member.

General Terms and Conditions

The following terms and conditions set forth in this Section 2 apply to your use of the Site and as well as your use of any of our Facilities.

Privacy Policy and Our Creative Environment

H.O.M.E. is committed to maintaining your privacy. Your Registration Information and any other information about you or your Account is subject to the terms of H.O.M.E.'s privacy ("Privacy Policy"), which can be found at http://www.homeformusic.org/privacy. The Privacy Policy is hereby incorporated into these Terms by reference.

Please also note that our Facilities and the events we provide form part of the creative environment that we emphasize here at H.O.M.E. As part of this creative environment, we encourage you and other members to meet, network, and collaborate as far as you and the other members are comfortable doing so. However, please carefully consider what you share and with whom you share as you are ultimately responsible for protecting your creative ideas and works. We are not responsible for any other member that uses any material that you may have shared with that member whether directly (for example, through collaboration) or indirectly (for example, through overhearing at a Facility or through the Site). 

As part of this creative environment, you may be filmed at one of our events that you attend and we may take pictures of you at our events and/or while using one of our H.O.M.E. Facilities. You acknowledge and agree that we may use those videos and pictures for our own business purposes, such as advertising our services to current and potential customers. 

Your Information

In order to become a member with us or to access member-only content on the website or HOME for Music App, you must join H.O.M.E. by completing the membership signup process and paying the applicable membership dues fees. If you elect to use the HOME For Music App, you agree to share your information with our administrative partner, HOME for Music, LLC (a technology and media company owned by HOME Founder, Logan Crowell) and to provide true, accurate, current, and complete information ("Registration Information") as requested by the application and activation forms. In addition, you agree to maintain and promptly update such Registration Information to keep it true, accurate, current, and complete the entire time you use the Service.

Fees and Billing

  1. Fees.  The current fees for the Service ("Fees") can be found at https://www.homeformusic.org/become-a-member. If the Service you have selected in your registration requires payment of a Fee, you agree to pay such Fees promptly, along with any applicable taxes. We reserve the right to change the Fees at any time, provided, however, that we will not change the Fees we charge you during your current subscription. However, please note that if you have a month-to-month membership, we will give you at least ten (10) days advance notice before your renewal date in the event we increase the Fees before your next monthly payment. If you have committed to a yearly membership, we will give you at least thirty (30) days notice before your renewal date in the event we increase the Fees before your next yearly payment. If you find such changes unacceptable, you may choose not to renew your membership after its expiration date. 

  2. Billing.  You are responsible for any and all charges to your Account. If you have any questions about charges to your Account, you should contact H.O.M.E.'s customer service department at support@homeformusic.org. All charges will be considered valid unless disputed in writing within thirty (30) days of the billing date. Adjustments will not be made for charges that are more than thirty (30) days old. Accounts with overdue Fees may be suspended or canceled at H.O.M.E.'s sole discretion and in any event, we will cancel your Account if you are more than ninety (90) days overdue on any Fees you owe H.O.M.E. Charges will continue to accrue for suspended Accounts until the Account is canceled. H.O.M.E. may require you to pay any overdue Fees and/or impose an additional charge to reinstate a suspended or previously canceled Account.

  3. Payment by Credit Card, Debit Card, Electronic Funds Transfer.  If you elect to pay your Fees by credit card, debit card, or electronic funds transfer, we will bill such Fees immediately upon signup or membership invoice. H.O.M.E. is not responsible for any charges or expenses (e.g. for overdrawn accounts, exceeding credit card limits, etc.) resulting from charges billed by H.O.M.E.

  4. Auto-Renewal. At this time, all accounts are auto-renewing, meaning that we will automatically renew your membership and bill your credit card on the anniversary (monthly or yearly) of your most recent membership registration. For billing purposes, we will encrypt and securely store your credit card information and may ask you to update it if you choose to renew your membership.

Modifications to Service

H.O.M.E. reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice to you. You agree that H.O.M.E. shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Termination

You or H.O.M.E. may terminate or cancel your Account at any time. If you have prepaid any Fees for your account and your Account is later terminated or canceled for any reason, we will not provide any refunds or credits to you.

  1. Termination by Member: You may cancel your Account or any part of the Service with 30 days notice. If you cancel or terminate your Account, cancellation will become effective upon the expiration of your membership subscription term, or immediately if you so choose. To cancel, visit https://www.homeformusic.org/cancel.

  2. Termination by H.O.M.E.:  H.O.M.E., in its sole discretion and at any time, may terminate your password, your Account, your access and presence on the Site, or your use of the Service, and remove and discard any of your User Generated Content within the Service, for any reason, including, without limitation: (1) if you have breached these Terms; (2) if H.O.M.E. is unable to verify or authenticate any information you have provided to H.O.M.E.; (3) if H.O.M.E. believes that you have violated or acted inconsistently with the letter or spirit of these Terms; (4) for lack of use of a free Service; or (5) if a free trial period has expired without your registration. H.O.M.E. may also, in its sole discretion and at any time, discontinue providing the Service or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these Terms may be effected without prior notice, and acknowledge and agree that H.O.M.E. may immediately deactivate or delete your access to the Site and all related information and files in your Site and/or bar any further access to such files or the Service. Further, you agree that H.O.M.E. shall not be liable to you or any third-party for any termination of your access to the Service or H.O.M.E.’s deletion of your User Generated Content.

Indemnification

You agree to indemnify, defend, and hold H.O.M.E., and its subsidiaries, affiliates, officers, agents, contractors, licensors, co-branders or other partners, and employees, harmless from any and all suits, actions, losses, claims, proceedings, demands, expenses, damages, settlements, judgments, injuries, liabilities, obligations, risks, and costs, including, without limitation, reasonable attorneys' fees, made by any third party due to or arising out of your User Generated Content, your use of the Service and/or Sites, your connection to the Service, your violation of these Terms, your breach of any warranties in these Terms, your violation of any law, rule, or regulation, and/or your violation of any rights of another. H.O.M.E. reserves the right, at your expense, to assume the exclusive defense and control of any matter which you are required to indemnify against, and you agree to cooperate in H.O.M.E.’s defense of such matter.  This indemnification shall survive any termination of these Terms.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  1. YOUR USE OF THE SERVICE AND SITES IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. H.O.M.E. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;

  2. H.O.M.E. MAKES NO REPRESENTATION OR WARRANTY THAT (1) THE SERVICE WILL MEET YOUR REQUIREMENTS; (2) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, CURRENT, COMPLETE, RELIABLE, VIRUS-FREE, OR ERROR-FREE, (3) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE, (4) THE QUALITY OF ANY PRODUCTS OR SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (5) ANY ERRORS IN THE SERVICE WILL BE CORRECTED;

  3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL AND TO TAKE ALL NECESSARY PRECAUTIONS TO ENSURE ANY CONTENT YOU MAY OBTAIN THROUGH THE SERVICE IS FREE OF VIRUSES; AND

  4. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM H.O.M.E. OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY OR REPRESENTATION NOT EXPRESSLY STATED IN THESE TERMS.

LIMITATION OF LIABILITIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT H.O.M.E. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (REGARDLESS IF YOU OR H.O.M.E. HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (1) THE USE OR THE INABILITY TO USE THE SERVICE; (2) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (3) UNAUTHORIZED ACCESS TO OR ALTERATION OR DELAY OF YOUR TRANSMISSIONS OR DATA; (4) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; (5) ANY PERSONAL INJURY (INCLUDING DEATH) OR DAMAGE TO PERSONAL PROPERTY THAT OCCURS WHILE AT ANY H.O.M.E. CHAPTER LOCATION OR OFF-SITE EVENT; (6) ANY OTHER MATTER RELATING TO THE SERVICE; (7) ANY ACTION TAKEN IN CONNECTION WITH COPYRIGHT OR OTHER INTELLECTUAL PROPERTY OWNERS; (8) ANY ACTION TAKEN IN CONNECTION WITH AN INVESTIGATION BY LAW ENFORCEMENT AUTHORITIES REGARDING YOUR OR ANY OTHER PARTY'S USE OF THE SERVICE; (9) RELIANCE BY ANY PARTY ON ANY CONTENT OBTAINED THROUGH USE OF THE SERVICE; OR (10) WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, TELECOMMUNICATIONS FAILURE, THEFT OR DESTRUCTION OF, THAT ARISE IN CONNECTION WITH: (A) MISTAKES OR OMISSIONS IN, OR DELAYS IN TRANSMISSION OF, INFORMATION TO OR FROM THE USER; (B) INTERRUPTIONS IN TELECOMMUNICATIONS CONNECTIONS TO THE SITE; OR (C) VIRUSES.

OUR TOTAL LIABILITY TO YOU FROM ALL CAUSES OF ACTION AND UNDER ALL THEORIES WILL BE LIMITED TO THE AMOUNT YOU HAVE PAID FOR THE USE OF THE SERVICE DURING THE TIME WHICH LIABILITY AROSE, IF ANY, AND IF YOU HAVE PAID NO AMOUNT, THEN $50.  YOU ALSO ACKNOWLEDGE AND AGREE THAT YOU HAVE VIEWED OR USED THE SERVICE WITH A FULL UNDERSTANDING OF THE LIMITATION OF OUR LIABILITY IN THESE TERMS.

BY ACCESSING AND USE THE SERVICE, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND, AND HEREBY EXPRESSLY WAIVE, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY, WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”

We are not liable for the actions of other individuals. We do not control and are not responsible for the actions of other individuals you encounter through the Service. You should be aware that other users or H.O.M.E. members may not be who they claim to be. We do not perform background checks on our users or H.O.M.E. members nor do we guarantee that our users’ or any H.O.M.E. members’ profiles or Account information are accurate. We do not endorse, support or verify the facts, opinions or recommendations of our users or any H.O.M.E. members. If a dispute arises between users, we shall have no responsibility or obligation to participate, mediate or indemnify any party.

Some jurisdictions do not allow exclusions of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you to the extent prohibited by law. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Notice & Communication

When you visit the Site or send messages to us, you are communicating with us electronically. You hereby consent to receive communications from us electronically. H.O.M.E. and HOME for Music, LLC will periodically sent you notices, reminders and marketing messages through the HOME for Music application, the email address you have listed in your Account, as well as text (SMS)/voice communications at the phone number that you have provided or through regular mail. H.O.M.E. may also provide notices of changes to these Terms or other matters by displaying notices or links to notices to you generally on the Service. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms.

General Terms

The Service is operated by H.O.M.E. from its offices within the United States of America. H.O.M.E. makes no representation that the information available through the Service is appropriate or available for use in other locations, and access to and use of the Service from territories where the contents of the Service may be illegal is prohibited. Those who choose to access and use the Service from other locations do so, on their own initiative and are responsible for compliance with applicable local laws. By using the Service, regardless of where you live or are located in the world, you consent to these Terms. These Terms constitute the entire agreement between you and H.O.M.E. and govern your use of the Service, superseding any prior agreements between you and H.O.M.E. (including, but not limited to, any prior versions of the Terms). The Terms and the relationship between you and H.O.M.E. shall be governed by the laws of the State of Tennessee. You and H.O.M.E. agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Davidson, Tennessee. The failure of H.O.M.E. to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. You may not assign these Terms without H.O.M.E.’s prior written consent. We may assign these Terms without restriction or condition. You agree that any claim you may have arising out of or related to your use of the Service or your relationship with H.O.M.E. must be filed within one (1) year after such claim arose; otherwise, your claim is permanently barred. You agree that any violation, or threatened violation, by you of these Terms constitutes an unlawful and unfair business practice that will cause us irreparable and unquantifiable harm. You also agree that monetary damages would be inadequate for such harm and consent to our obtaining any injunctive or equitable relief that we deem necessary or appropriate. These remedies are in addition to any other remedies we may have at law or in equity. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. The section titles in the Terms are for convenience only and have no legal or contractual effect.

Copyright Infringement Notification

We respect the intellectual property rights of authors. To assist copyright owners, we have appointed an agent to receive notifications of claims of copyright infringement regarding materials available or accessible on, through, or in connection with our Site and services in compliance with Section 512 of Title 17 of the United States Code (“Copyright Act”).  Any person authorized to act for a copyright owner may notify us of such claims by contacting our “Designated Agent”: Logan Crowell, HOME for Music, LLC, 615 Main St. H7, Nashville, TN, 37206; Phone: 501.940.0852; Email: logan@homeformusic.app; and providing all relevant information, including a description of the copyrighted work that you claim has been infringed upon, a description of where such material is located on the Site, a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law, a statement made by you under the penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner, your address, telephone number and email address, a physical signature of the person authorized to act on behalf of the copyright owner, and any other information as may be required by Section 512(c)(3) of the Copyright Act.  The contact information for the Designated Agent is also available from the Register of Copyrights. The foregoing contact information is for use solely with notice of copyright infringement and you may not receive a response to any other communications, feedback, comments or requests for technical support delivered to the foregoing address or e-mail.

Online Terms and Conditions

The following terms and conditions set forth in this Section 3 apply only to your use of the Site.

Use of Member Account

You are the authorized user of your HOME For Music Account and must comply with these Terms. You must keep your password confidential so that no one else may access the Service through your Account. Anyone with knowledge of or access to your Account password can use that information to gain access to your Account. You are solely liable for any claims, damages, losses, costs or other liabilities resulting from or caused by any failure to keep your information confidential, whether such failure occurs with or without your knowledge or consent.  You will immediately notify us of any suspected or actual unauthorized access to, or use of, your information or any other breach of your Account security. Any commercial use of your Account is prohibited.

Member Content

You, and not H.O.M.E., are solely responsible for all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials uploaded, posted, displayed, or otherwise transmitted by you via homeformusic.app and the corresponding Circle community mobile application ("User Generated Content"). You acknowledge and agree that all such User Generated Content will comply with these Terms and you may not use any fake e-mail address or impersonate any other person or entity or otherwise mislead as to the origin of the User Generated Content. You represent and warrant that all User Generated Content you submit to the Sites or otherwise to us is accurate, truthful and non-deceptive and that all User Generated Content has evidence to back up the claims made.  You further represent and warrant that you own or otherwise control all of the proprietary rights to the User Generated Content that you submit or post to the Sites or us and that you will indemnify H.O.M.E. for all claims resulting from any User Generated Content you submit to us or post to the Site. H.O.M.E. does not control the User Generated Content and, as such, does not guarantee the accuracy, integrity, or quality of such Content. H.O.M.E. reserves the right, but is not obligated, to review the User Generated Content and to refuse, remove, or edit any such materials, in whole or in part, in its sole discretion, without notice at any time.

Member Usage Limits

H.O.M.E. may, from time to time, establish general practices and limits concerning the use of the Service ("Limits") , including without limitation: (a) maximum limits on storage space; (b) maximum limits on bandwidth usage; and (c) maximum limits on the number of days that email messages, guest book entries, or other materials will be retained on the Site. Such Limits may be set according to the level of Service for which you have registered. If you exceed the Limits set forth for your Service level, H.O.M.E. and/or its affiliates at HOME For Music reserve the right, at their sole discretion, to: (i) delete User Generated Content leading to the exceeding of such Limits; (ii) suspend your Account until you have brought your Account within such Limits; or (iii) charge you for exceeding such Limits under the terms set forth in the Fee schedule for your chosen level of Service. 

H.O.M.E. Proprietary Rights

You acknowledge and agree that content contained on the HOME For Music website and app, and information presented to you through the Service is expressly owned by H.O.M.E. and its applicable licensors, including, without limitation, our members. Everything on the Site is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Unauthorized use of any trademarks, service marks or logos used on the Site may be a violation of state, national and international trademark laws.  Additionally, our custom icons, graphics, logos and scripting on the Site may be covered by trademark, trade dress, copyright or other proprietary right law, and may not be copied, modified or used, in whole or in part, without our prior written permission. Except as expressly authorized by H.O.M.E., you agree not to copy, modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or its contents, in whole or in part.

Member Proprietary Rights

H.O.M.E. does not claim ownership of the User Generated Content you place on your site ("HOME For Music") or that you upload, post, or otherwise transmit via the Service. By submitting your User Generated Content to H.O.M.E. for inclusion in member features, you grant H.O.M.E. a world-wide, royalty-free, and non-exclusive license: (i) to host, use, reproduce, modify, adapt, distribute, transmit, and publicly display your User Generated Content on and through the Service; and (ii) to sublicense to third parties such Content to the extent necessary for the creation and maintenance of, in part or in whole, the Services, including, without limitation, for use in our marketing and advertising materials. This license exists only for so long as you continue to be a H.O.M.E. member, or until you notify us in writing that you no longer want us to use your User Generated Content, whichever occurs later. By submitting Content to H.O.M.E., you warrant and represent that you own or otherwise control the rights necessary to grant the above licenses.

Member Conduct

You agree not to use the newsfeed nor any other part of the Service or the Site to:

  1. upload, post, or otherwise transmit any User Generated Content or any other material that: (1) is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically; (2) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or (3) is otherwise objectionable;

  2. upload, post, or otherwise transmit any User Generated Content or any other material that is misleading to others or impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity to others;

  3. remove, obscure, or alter any proprietary notices (including any notice of copyright or trademark) of H.O.M.E. or its affiliates, partners, suppliers or its licensors;

  4. upload, post, or otherwise transmit any unsolicited or unauthorized direct advertising, announcements, materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation;

  5. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

  6. use the Service as storage for remote loading or as a door or signpost to another home page;

Facility Terms and Conditions

The following terms and conditions set forth in this Section 3 apply only to your use of our Facilities.

Use of H.O.M.E. Facilities

Depending on the type of membership you purchase from H.O.M.E., you may have access to certain locations and facilities at certain times and at additional cost to use our facilities (“Facilities”). We reserve the right, in our sole discretion, to limit the number of guests that we permit you to bring with you to our Facilities (if any). We also reserve the right to change the hours of availability that you can use our Facilities and any additional policies we may post at our Facilities, provide to you, or make generally available to our members. 

You agree that these Terms and your use of any Facility from H.O.M.E. are not subject to the Tennessee Uniform Residential Landlord and Tenant Act.   

When using or visiting any of our Facilities or if your membership permits you access to our Facilities, you will:

  1. use our Facilities responsibly and courteously;

  2. not sleep in our Facilities or store any of your equipment or other personal belongings other than as expressly permitted by us;

  3. only use our Facilities when and as permitted by us;

  4. be responsible for any damage caused to our Facilities, and any equipment, appliances, and furniture therein, from your use or any of your permitted guests’ use of our Facilities;

  5. only access our Facilities as permitted by us and as allowed by your reservation time (if applicable);

  6. not allow others to access or enter our Facilities without our permission or unless we invite them (e.g. to a public event or they have a sufficient membership) and will not share or otherwise allow others to use your personal access card or access application to our Facilities;

  7. leave our Facilities in the state in which you found them, i.e. clean and organized, ready for the next member to use;

  8. notify us of any damage to any Facility; 

  9. not use any unlawful drugs, tobacco products (or products similar to tobacco products, such as “vapor pens”) while on the premises of any Facility; and follow any additional rules or policies regarding your use of the Facilities that we post or make generally available and follow all requests of H.O.M.E. staff and employees. 

Insurance

Although, H.O.M.E. will carry insurance, as a Member, it is strongly suggested that you carry a Renters Insurance policy to cover your own equipment while using our Facilities. That policy may cover your current residence/office, as well as Facilities available through H.O.M.E.
